Pertanggungjawaban Hukum terhadap Penyalahgunaan Izin Tinggal WNA di Imigrasi Kelas II Belawan

Abstract

This study analyzes the forms of residence permit abuse committed by foreign national, the legal responsibility of immigration officers for the misuse of foreign nationals residence permits based on Law Number 6 of 2011 concerning Immigration, obstacles and efforts made by the Class II Belawan Immigration Office in handling these violations. This study uses a qualitative research method with an empirical legal approach, the location of the study is the Class II Belawan Immigration Office. The results of the study indicate that the most common residence permit violations are visa abuse and overstay. The causative factor for violations is the lack of foreign nationals understanding of the language, resulting in a lack of understanding of foreign nationals regarding the applicable residence permit regulations. This study highlights the implementation of the responsibilities of Class II Belawan Immigration Office Officers through the stages of document inspection to administrative action and also coordination between agencies in accordance with Law No. 6 of 2011 and the immigration authorities overcome theses obstacles by using interpreters, online immigration information systems, officer training, direct supervision in the field, and having a foreign national reporting application (Apoa).
