Relevansi Hak Eksklusif dalam Hak Cipta di Era Digital: Bagaimana Teknologi Artificial Intelligence Menggoyang Konsep Hak Moral

Abstract

The development of Artificial Intelligence has brought significant changes in the process of creating intellectual works, particularly in the context of copyright law. This technology not only functions as an aid but is also capable of producing works automatically through data-based algorithmic processing. This condition raises legal issues, particularly regarding the protection of creators' moral rights, which are conceptually inherent to human creators. This study aims to examine the concept of creators' moral rights in Indonesian and Malaysian copyright law and analyze the position of human creators compared to Artificial Intelligence in producing works protected by moral rights. The research method used is normative legal research with a statutory approach and a comparative legal approach. Legal materials are analyzed qualitatively through the interpretation of relevant legal norms and doctrines. The results show that both Indonesia and Malaysia place moral rights as personal rights inherent only to human creators and do not recognize Artificial Intelligence as a legal subject or creator. However, both legal systems do not yet have specific regulations that accommodate the protection of moral rights in the context of works produced with the help of Artificial Intelligence, thus creating legal uncertainty. This study confirms that although moral rights remain conceptually relevant, normative adjustments are needed to ensure their protection remains effective in the era of Artificial Intelligence development.
