Perlindungan Hukum dan Ganti Kerugian Bagi Korban Kebocoran Data Pribadi dalam Transaksi Digital: Perspektif Hukum Perdata Indonesia

Abstract


Personal data breaches in digital transactions raise legal concerns regarding the protection of data subjects and compensation mechanisms. Although Law Number 27 of 2022 on Personal Data Protection (PDP Law) grants data subjects the right to obtain compensation, the construction of civil liability, evidentiary mechanisms, and parameters for assessing damages remain insufficiently regulated. This study aims to analyze the right of data subjects to claim compensation, the relationship between the PDP Law and the Indonesian Civil Code, and the civil liability of data controllers from the perspective of Indonesian civil law. This normative legal research employs statutory, conceptual, case, and comparative approaches through library research. The findings demonstrate that the PDP Law and the Indonesian Civil Code operate complementarily, allowing breach of contract and unlawful act claims to be applied according to the legal relationship between the parties. This study proposes a risk-based civil liability model through the application of a presumption of liability against data controllers to strengthen the protection and recovery of victims' rights arising from personal data breaches.
