Disharmoni Regulasi Penggunaan Kendaraan Tertentu dengan Penggerak Motor Listrik terhadap Sistem Hukum Lalu Lintas Nasional

Abstract

Issues addressed include definitions, technical requirements, testing procedures, registration, law enforcement, and sanctions for electric vehicle users. The objective is to synchronize Ministry of Transportation Regulation Number 45 of 2020 with Law Number 22 of 2009 and to structure regulations concerning electric vehicles. This study employs a statutory approach, with a planned duration of six months. The scope of the research covers the synchronization between Ministry of Transportation Regulation Number 45 of 2020 regarding electric vehicles and Law Number 22 of 2009 regarding traffic. It focuses on alignment, integration, legal implications, and the regulatory framework for electric vehicles. Legal sources utilized include primary, secondary, and tertiary legal materials. The study is conducted in Indonesia, employing qualitative analysis. The findings indicate that the synchronization between Ministry of Transportation Regulation Number 45 of 2020 and Law Number 22 of 2009 is not yet optimal. There are legal gaps and a lack of regulatory integration, leading to confusion in practice. Consequently, legal uncertainty exists regarding the status of certain vehicles on public roads, potentially resulting in inconsistent law enforcement and ambiguity concerning sanctions. A comprehensive revision of the law, clear legal classification, and the standardization of sanctions are required to address the regulation of electric vehicles.
