Fungsi Pengawasan Dewan Perwakilan Daerah (DPD) terhadap Pelaksanaan Pengelolaan Sumber Daya Alam Menurut Peraturan Perundang-Undangan

Abstract

The Regional Representative Council (DPD) holds an oversight function regarding the management of natural resources—monitoring and evaluating the implementation of laws concerning resource exploitation and environmental conservation to ensure that such activities remain beneficial to the regions. Legal issues arise regarding the DPD’s authority in natural resource management due to the limitations of its constitutionally defined powers. Under the 1945 Constitution, the DPD may only submit its oversight findings to the House of Representatives (DPR) for consideration; it lacks the authority to enforce execution or impose legal sanctions for violations. This research employs both a statutory approach—examining regulations and the DPD’s oversight of natural resources—and a conceptual approach, which explores theories and perspectives on the DPD’s oversight function. The six-month research plan includes a literature review and an analysis of the effectiveness of the DPD’s oversight. The scope of the study encompasses the mechanisms and the extent of the DPD’s involvement in the oversight of natural resources. The research utilizes primary, secondary, and tertiary legal sources. Data collection relies on document analysis, and the findings are analyzed qualitatively to understand the role of the DPD. The study concludes that the DPD’s oversight of natural resource management faces several legal challenges: first, it lacks the coercive power to enforce its oversight findings; second, it is dependent on the DPR for follow-up action on its reports; and third, ambiguities within the legal norms weaken the DPD’s position. Ultimately, the DPD lacks robust executorial power, rendering its oversight findings mere recommendations devoid of any binding legal force.
