Abstract


The development of digital technology and artificial intelligence has led to the emergence of deepfake technology, which can realistically manipulate images, videos and audio. This technology can be misused to create and distribute sexual content without the victim’s consent, constituting a form of elektronic-based sexual violence (KBSE). This study aims to analyze the misused of deepfake technology as KSBE and the criminal liability of perpetrators under Law number 12 of 2022 concerning sexual violence crimes (UU TPKS). This study employs a normative juridical method using a statutory and conceptual approach. The results show that the misuse of deepfake technology to creat or distribute sexual content involving victims without their consent may be categorized as electronic-based sexual violence. Criminal liability may be imposed when the elements of a criminal offense, culpability, and criminal capacity are fulfilledm and there are no grounds for justification or exuse. Thereforem the implementation of UU TPKS needs to be optimized to provide legal certainty and effective protection for victims.
